Dear Friend,
I’ll never forget the day my life’s work changed.
My client and I were sitting in family court, waiting for my client’s divorce case to be called.
While we waited, there was another case being heard by the judge.
In that case, a lady was asking the judge to issue a Domestic Violence Restraining Order against her ex-husband.
She just called her ex to the witness stand, and she was about to start asking him questions.
This would be her moment to force him to answer up to the wrong he had done to her.
She was about to really lay into him by cross-examining him.
And the thing was, the guy looked like a jerk. He had this smug look on his face that instantly made you hate him.
Here’s Where Things Go Bad
So this young lady asked her first question of her ex…
“Isn’t it true that you hit me three times?”
As soon as she asked the question, I heard someone say loudly, “Objection!”
It was the smug ex-husband’s lawyer. He objected to the lady’s question.
Uh oh.
I knew exactly what was going to happen next.
“Sustained,” the judge said.
The judge would not let her ask the question because it was vauge as to time and she had not laid proper foundation.
What did the lady do?
Instead of asking a question, this time she accused him of hitting her.
“Objection!” once again the ex’s lawyer yelled.
“Sustained,” the judge replied.
Of course. Cross-examination requires questions, and she didn’t ask a question. So of course the judge was not going to let her continue.
When Things Go Bad, They Go Really Bad
What did the lady do next?
She changed the topic entirely, asking a different question.
Again, the lawyer yelled, “Objection!”
And once again the judge answered, “Sustained!”
At that point I was feeling really bad for this lady. But I was rooting for her.
In my head I was thinking, “Come on, you can do it. Just change the wording of your question a little bit, and you’ll be fine.”
What Happened Next Shocked Me
The lady said, “I have no more questions,” and she sat down.
I wanted to yell, “What!?! Just like that, you’re going to give up?”
I just about fell out of my chair.
This poor lady clearly had no idea what to say, how to ask questions the right way, and had no way to fix solve the problem.
She was stuck.
So she gave up.
A few minutes later, the judge denied her request for a restraining order.
She walked out of court hanging her head with a loss.
And her smug ex and his loud-mouth lawyer walked out as winners.
